DEPARTMENT OVERVIEW

The Equity & Equal Protection Office is responsible for the administration of UCSC's policies and procedures regarding discrimination and harassment on the basis of race, religion, disability, sex, gender, age and other protected identities including title IX. Our work includes stewarding complaint processes for students, staff, and faculty who have experienced discrimination and ensuring that members of our community can engage in protected activity free from retaliation. We are responsible for the University's compliance with state and federal laws relating to discrimination to ensure that no member of our community is denied participation in an academic program or employment based upon a protected identity or engaging in protected activity. JOB SUMMARY

The incumbent serves as the Title IX Officer for UCSC and leads UCSC's sexual harassment/sexual violence strategic planning, ensures compliance with Federal Title IX regulations and University policies, and serves as the lead campus resource person for matters pertaining to the Violence Against Women Act (VAWA) and Title IX. The Title IX Officer facilitates the resolution of sex based discrimination, sexual harassment, and sexual violence complaints of faculty, staff, students, and others who engage with the university; conducts research and legal analyses on relevant laws and regulations; develops local policies and guidelines; and oversees the training programs designed to educate the University community on sex based discrimination, sexual harassment and sexual violence prevention and mandated reporting. Reporting to the Associate Vice Chancellor for EEP (AVC EEP) the Title IX Officer supervises the Director of Investigations and Director of Prevention and Initial Response. The Title IX Officer, in collaboration with the AVC EEP, represents UCSC and serves on various UCSC committees.

Salary Information: Salary Range: $130,000 - $170,000/annually. Salary commensurate with skills, qualifications and experience.

JOB DUTIES

45% - Case Management
  • Conducts assessments of initial complaints of harassment and discrimination (including sexual misconduct) to determine the merit of complaints; interviews the impacted party, gathers relevant information, advises impacted parties of their rights and options. Maintains a high level of confidentiality and ensures appropriate documentation.
  • Implements supportive, interim, and remedial measures as appropriate and makes appropriate referral to Director of Investigations and Complaint Resolution for case management and complaint resolution.
  • Provides consultation and determines avenues for resolution, assesses potential liability, and advises managers and supervisors on appropriate corrective and remedial action.
  • Collaborates and consults with the AVC EEP regularly to monitor and manage incident reports to ensure an efficient and effective response to reported incidents.
  • Provides periodic, timely updates regarding the status of complaints received and investigations in progress to AVC EEP.
  • Provides guidance, support, and oversight to the Director of Investigations and Complaint Resolution to ensure thorough and timely investigations. Ensures comprehensive written investigative reports that clearly identify the issues investigated, summarizes the evidence, correlates findings to University policy, and recommends appropriate remedial steps. Reviews investigation plans including timeline.
  • Ensures accurate and thorough records and notes to ensure a well-documented investigatory process.
  • Leads task forces to respond to the highest profile complaint cases and / or those with significant potential impact to the organization. Advises on issues without precedence. Provides industry benchmarks.
  • Ensures management corrective actions are in place following complex and or politically sensitive investigations. Confirms appropriate monitoring controls are utilized. Responsible for the most sensitive of investigation subjects.
  • Provides consultation and information regarding Title IX and VAWA (Violence Against Women Act) requirements to all involved parties.


25% - Compliance
  • Oversees Title IX compliance for UCSC.
  • Participates with high level management in strategic thinking and planning in regards to ethics and compliance policy. Develops benchmarks / training for complex topics. Represents the organization to external agencies. Manages external inquiries.
  • Identifies compliance issues of importance to the organization which frequently cross organizational lines. Collaborates with the AVC EEP to develop appropriate analytical and procedural framework for addressing the issues in the organization.
  • Remains knowledgeable of current state and federal law, regulations, and trends in the field of education related to harassment and other discriminatory practices, including those that violate Title IX.
  • Maintains current inventory of regulations and statutes relating to sex, gender based violence including, but not limited to, Title VI, Title VII, Title IX, VAWA, Campus Save Act, Clery Act and any new legislation on the subject.
  • Assists in maintaining requested statistics and data for reporting purposes, specifically using EEP database and management systems.
  • Ensures organization has appropriate critical coordinated response systems with effective and efficient controls in place. Confirms organization compliance with legal and regulatory requirements in a complex changing environment. Provides cross functional coordination for risk mitigation.
  • Develops proposals and recommendations to guide and support a broader strategic direction for EEP and the Title IX program.
  • Works with campus offices and other UC's to build a coordinated system-wide approach to comply with relevant policy, including Title IX.


15% - Supervision
  • Supervises Director of Investigations and Director of Prevention and Initial Response for EEP and provides leadership, guidance, education, and policy development to the organization on ethics and compliance, and provides day-to-day guidance and support as needed.
  • Recruits, hires, trains, monitors, and evaluates performance and takes actions as required assuring high levels of productivity and morale.
  • Designs and implements professional development initiatives for staff.


10% - Training and Outreach
  • Develops and implements training programs on compliance policies and procedures under the purview of EEP and diversity/inclusion related topics as needed and as time allows.
  • Collaborates with the AVC EEP and Director of Prevention & Initial Response EEP/Title IX Response Team Coordinator, as well as other campus managers, to assess EEP's educational and training needs for specific units and the campus as a whole.
  • Contributes content to campus Title IX training working closely with the Director of Prevention & Initial Response EEP/Title IX Response Team Coordinator and other EEP staff, Systemwide Title IX Office staff, Staff Human Resources, Academic Personnel Office and others as appropriate.


5% - Special Projects
  • Participates in campus-wide or system-wide workgroups in support of Title IX projects and initiatives.

 

REQUIRED QUALIFICATIONS
  • Bachelor's degree in related area and / or equivalent experience / training.
  • Expert knowledge of the ethics and compliance profession, theories and systems of internal control and professional compliance and investigations standards.
  • Expert knowledge of University ethics and compliance policies, procedures and programs.
  • Demonstrated grasp of Return on Investment (ROI) concepts.
  • Applies sound principles and standards in completing highly complex and technical assignments.
  • Ability to gather, organize, analyze, and report on issues and recommendations that are complex in nature. Ability to apply policy and legal concepts to issues.

  • Demonstrated skill, sensitivity and experience interacting with constituents who are diverse in characteristics such as age, education level, race, gender identity and expression, ability, and socioeconomic backgrounds in a culturally-competent manner.
  • Demonstrated understanding of the relevance of trauma in the context of sexual violence (for example, the neurobiology of trauma and trauma-informed investigation techniques).
  • Demonstrated written communication skills.
  • Ability to gather and organize information, conduct analysis, and make recommendations on issues that are complex in nature; critical thinker.
  • Demonstrated ability to work independently.
  • Experience supervising or leading a team.

PREFERRED QUALIFICATIONS
  • Leadership expertise and political acumen overseeing sensitive complaint resolutions within a large, complex organization.
  • Bilingual language skills.
  • Thorough knowledge of the Clery Act. Experience with Clery reporting.
  • Thorough knowledge of Whistleblower and Whistleblower Retaliation laws

 

SPECIAL CONDITIONS OF EMPLOYMENT
  • Selected candidate will be required to pass a pre-employment criminal history background check.
  • The selected candidate will be required to work primarily on campus, with periods of remote work possible based on operational needs, and be able to fulfill requirements of the UCSC telecommuting agreement.
  • Ability to work a variable schedule.
  • Selected candidate will be required to complete training within established time frames as directed including UC compliance training.
  • Within six months of their hire, newly-hired Title IX Officers, Deputy Title IX Officers, Investigators/Case Resolution Officers and Hearing Officers must complete 16 hours of comprehensive training. Continuing Title IX Officers, Deputy Title IX Officers, Investigators/Case Resolution Officers and Hearing Officers will complete at least ten hours of continuing education relevant to their job function annually, between July 1 and June 30. Employees have discretion to select trainings to meet this requirement, but must meet the hours requirements below at least every two years.
  • Ability to travel to multiple work locations on and off campus.
  • Ability to travel within a defined regional or service area.
  • Ability to maintain appearance and conduct suitable for working in a professional setting.
