Senior Legal Counsel, Fiduciary Litigation at Northern Trust

Job Description:


The Fiduciary Litigation Division (FLD) reports to the Global Co-Head of Litigation, Investigation, and Regulatory Enforcement. The FLD has a national mandate and is responsible for ensuring timely and comprehensive management and responses to a variety of fiduciary litigation and pre-litigation contested matters and providing day-to-day legal advice to a variety of stakeholders at Northern Trust. Matters include, but are not limited to, breach of fiduciary duty claims, breach of trust claims, malpractice claims, ADA violations, shareholder claims, complex commercial disputes, wrongful death cases, and restraining orders.

Major Duties:

1. Responsible for managing trust or estate-related litigation and disputes typically involving assets under custody or management, customers, beneficiaries or related third parties. A successful candidate will manage all aspect of assigned matters such as developing and implementing strategy with internal and external stakeholders, conducting early matter assessments, managing budget, reviewing outside counsel and junior internal counsel work product and overseeing discovery.

2. Responsible for hiring, supervising, and working collaboratively with outside counsel and other legal and forensic vendors.

3. Responsible for advising a variety of Northern Trust departments on litigation strategy and litigation risk.

4. Leads and supervises factual investigations in connection with a wide range of legal issues to identify issues in dispute and to support pending and potential litigation and regulatory matters.

5. Conducts complex legal research and prepares summaries of findings.

6. Provides supervision and assistance in responding to third subpoenas. A successful candidate will effectively and efficiently supervise a team of internal and external colleagues in responding to discovery and will understand third-party discovery well enough to recognize potential litigation risk involving the company.

7. Responsible for preparing employees, with or without the assistance of outside counsel, for deposition and trial/hearing testimony.

8. Handles assorted miscellaneous litigation matters with minimal supervision.

9. Interacts with partners (e.g., relationship managers, Risk/Compliance, Tax, Legal Department, Human Resources) or external parties (e.g., regulators, other financial institutions, investigations staff) in the course of information gathering, as appropriate.

Knowledge/Skills:

• Candidates must have 7+ years of experience litigating matters with some experience in the trust and estate context.

• Leadership and organizational skills are required.

• Experience working with trustees, administrators, estates and/or other fiduciary relationships is needed.

• The position requires management capabilities, strong analytical ability, strong judgment, independence, and communication skills to work effectively with clients, management and staff at all levels, from administrative assistants and junior lawyers to senior lawyers, executives, and important external partners.

• Familiarity with case valuation, risk assessment, and management of e-discovery, legal hold, and document management processes are ideal.
