Overview

The Deputy Counsel shall be responsible for research, drafting documents, and certain transactional issues from commencement to closing. The Deputy Counsel will assist department attorneys as directed on such matters involving Medicare and Medicaid (including fair hearings and ALJ hearings), New York State regulatory compliance for IHA and its affiliates, in addition to assisting with other contractual work related to provider and member agreements, vendor agreements, service agreements and business associate agreements.
Qualifications

Juris Doctor Degree required; admitted to practice law in New York State required.

Four (4) years of law firm or in-house counsel experience with health law and regulatory compliance required.

Proven ability to negotiate and work with clients on various forms of agreements and contracts.

Knowledge of and familiarity with one or more of the following areas preferred: HIPAA, ACA, Medicare and Medicaid laws, rules and regulations, including fair hearings and ALJ proceedings; New York Public Health Law; and Insurance Law.

Legal research experience with excellent written and oral communication skills; strong interpersonal and negotiation skills.

Knowledge and experience in dealing with Federal and State regulatory entities preferred.

Ability to interpret laws and regulations for various lines of business and identify impact to the Company.

Ability to understand business objectives and to provide legal advice in a business context.

Essential Accountabilities
-
Assist department attorneys as needed, specifically in the areas of Managed Care, Insurance, Medicare and Medicaid (including fair hearings and ALJ proceedings), provider and member contracts, and regulatory matters for IHA and its affiliates.

Draft and review contracts and documents for approval, including provider agreements, HIPAA business associate agreements, service agreements and vendor contracts.

Support department attorneys and staff in the processing and response to subpoenas and governmental inquiries.

Assist with HIPAA privacy and security issues and events, negotiate data-sharing agreements with providers and other stakeholders, and draft Business Associate Agreements.

Interpret state and federal laws and regulations governing individual and group health insurance products.

Perform legal research; review proposed state and federal rules and regulations and draft comments to same.

Draft correspondence, memoranda, briefs, etc. concerning legal issues.

Communicate and correspond with federal and state regulators, draft responses to regulatory and other outside inquiries.

Advise and counsel IHA personnel, departments and committees as requested.

Review current statutes, regulations, and assist the Chief Compliance Officer in implementation of new laws and ongoing compliance.

Represent legal department at committee meetings as assigned by supervising attorney.

Provide legal advice to internal business clients, develop solutions to business problems by developing familiarity with the business, structure and industry, as well as the culture and risk management standards.
