The Sr. Legal Counsel role will provide legal services and advice to our pharmaceutical benefit management business, including day-to-day legal counseling and negotiating of transactions between such business and pharmaceutical manufacturers, other suppliers, pharmacies and wholesalers, and pharmaceutical support companies. The qualified candidate must possess an ability to develop detailed understanding of complex business operations and interdependencies in a fast paced environment. The qualified candidate will have a minimum of 5 years’ healthcare regulatory or transactional experience with a reputable law firm or in-house legal department. Knowledge of health care fraud, waste and abuse law is a big plus. Compensation will consist of competitive base salary, bonus eligibility, and eligibility for equity compensation awards.
Analyze complex transactions between Express Scripts’ pharmaceutical benefit management business and pharmaceutical manufacturers, including formulary rebate arrangements.
Provide day to day legal counseling on operational and transactional matters relating to the formulary rebates and the pharmaceutical benefit management businesses.
Negotiate miscellaneous contracts between Express Scripts’ pharmacy benefit management business and pharmaceutical manufacturers.
Engage and manage outside counsel as necessary to respond to internal client legal questions.
Work with other internal legal counsel in analyzing complex transactions and to identify legal issues with cross-divisional impact.
Conduct privileged investigations and train internal business clients as assigned by supervisor.
J.D. required from an accredited school of law.
Licensed to practice law in the State of Missouri, or an ability to do so promptly after hire.
A minimum of three to five years of health care transactional or regulatory experience, preferably in the health care law department of a reputable law firm with emphasis on anti-kickback, HIPAA, and other Federal healthcare and fraud and abuse laws and regulations; experience with general business contracting; experience with a pharmaceutical manufacturer or health care provider a plus.
Must use sound judgment to make decisions, communicate effectively verbally and in writing, work well with others in a team environment to resolve complex issues, and possess strong analytical skills.
Must be organized to professionally manage multiple projects in a demanding work environment.
